Muslim Marriage Registration in India, Which Act Applies and How to Register

A Muslim marriage in India is valid once the nikah is done under Muslim personal law, with the bride's and groom's consent, two witnesses and the mehr fixed. Registration with the state is a separate step. There is no single central act for registering a nikah. Which law applies depends on the state, and in most states today it is a compulsory registration law that covers every religion.
The nikahnama the qazi gives you is the main proof. You take it to the state registrar to get a marriage certificate.
Muslim Marriage Registration Under Which Act?
In India, marriage among Muslims is governed by Muslim personal law, under Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937. That Act decides the marriage itself. It does not set up a registration system.
Registration comes from one of four kinds of law, depending on where you live.
| Kind of law | Where | What it does |
|---|---|---|
| State compulsory registration laws for all religions | Tamil Nadu, Kerala, Maharashtra, Uttar Pradesh, Bihar, Madhya Pradesh, Chhattisgarh, Punjab, Himachal Pradesh and others | The nikah is registered like any other marriage, at the local body or the sub-registrar |
| Old Muhammadan marriage registration acts | West Bengal, Bihar, Jharkhand and Odisha, as listed by the Law Commission in 2008 | Licensed Muslim marriage registrars may register nikahs and divorces, on a voluntary basis |
| Assam's 2024 Act | Assam | Registration of Muslim marriages and divorces is compulsory, by government registrars |
| Special Marriage Act, 1954 | All India | A nikah already performed can also be registered under this Act |
The Law Commission's Report No. 211 of 2008 describes the older system. It says the Bengal act of 1876 was in force in West Bengal, Bihar and Jharkhand, Odisha had re-enacted it in 1949, and Assam and Meghalaya had their own versions. Under all these acts, registration was a facility, and not registering did not make a nikah invalid.
Since then, most states have brought in compulsory registration rules for all marriages, after the Supreme Court's 2006 direction in Seema v. Ashwani Kumar. So in many states the old and the new systems now sit side by side. Ask your local registrar which one they use.
The Qazi and the Nikahnama
The qazi who reads the nikah fills in the nikahnama. It is signed by the groom, the bride, her wali or vakil, two witnesses and the qazi. The Law Commission report notes that nikahnamas issued by qazis are admissible as evidence in Indian courts.
That makes the nikahnama strong proof, but it is not a state marriage certificate. Passport offices, visa officers and banks increasingly ask for the certificate from the state registrar. Our page on the nikahnama explains the document and how to get a copy.
Muslim Marriage Registration Process, Step by Step
The steps are much the same in most states with a compulsory registration law.
- Get the nikahnama signed and sealed on the day. Check that names match Aadhaar or the passport.
- Find the right registrar. In most states this is the registrar for the place where the nikah took place: the municipality, gram panchayat or sub-registrar office.
- Fill the memorandum or application form, online where the state has a portal.
- Attach the documents listed below.
- Appear before the registrar with two witnesses if asked. Many states want both spouses present at least once.
- Pay the fee shown by the office or portal.
- Collect or download the certificate, and check every spelling.
Do it within the time limit of your state. Many states give 30 days. Tamil Nadu gives 90. A late filing is usually still possible, with a late fee or a written reason.
Documents for Muslim Marriage Registration
Most registrars ask for these. Your state may add or drop one.

- Age proof of both, such as a birth certificate, school certificate or passport
- Address proof of both
- Photos of the couple, often a joint photo too
- ID proof of the two witnesses
- The wedding card, if printed
- For a widowed or divorced spouse, the death certificate of the earlier spouse, or proof of divorce
- A certificate from the mosque committee or qazi, where the state's form asks for it

Muslim Marriage Registration in Tamil Nadu
Tamil Nadu has the clearest rule. The Tamil Nadu Registration of Marriages Act, 2009 makes registration compulsory for every marriage held in the state, of any religion. A nikah is registered at the Sub Registrar office of the area where it took place, through the TNREGINET portal.
The memorandum is due within 90 days. Tamil Nadu's Registration Department lists the fee as ₹100 on time, with higher fees for late filing. Our page on marriage registration in Tamil Nadu has the full fee table and steps, with links to the department's own pages.
Muslim Marriage Registration in Kerala
Kerala's Registration of Marriages (Common) Rules, 2008 cover marriages of all religions held since 29 February 2008. A nikah in Malappuram is registered at the local body where it took place, through the K-SMART portal, within 45 days to avoid a late fee. The mosque committee's certificate is the usual proof that the marriage took place. See our guide to marriage registration in Kerala.
Muslim Marriage Registration in Assam
Assam passed the Assam Compulsory Registration of Muslim Marriages and Divorces Act, 2024, and repealed the 1935 act under which licensed kazis registered marriages. Registration is now compulsory and is done by government registrars. When the bill passed, the Chief Minister said registrations already done by kazis would remain valid.
A petition challenging the new law was filed in the Gauhati High Court in 2024, and we could not confirm how it ended. Our page on marriage registration in Assam has the current steps.
Registering a Nikah Under the Special Marriage Act
Section 15 of the Special Marriage Act, 1954 lets a couple register a marriage already performed in another form, if both are at least 21, have only one spouse living, and meet the other conditions. A 30-day public notice comes before registration.
Couples use this route mainly for a spouse visa abroad, because embassies know the Special Marriage Act certificate well. Once a marriage is registered under this Act, the Act's rules on divorce and succession apply to it. Speak to a lawyer before choosing it.
Common questions
Is Registration of Muslim Marriage Compulsory in India?
There is no central law making it compulsory. But most states have compulsory registration rules for all marriages, and Assam has a 2024 law for Muslim marriages in particular. A nikah without registration is still valid under Muslim personal law.
Under Which Act Is a Muslim Marriage Registered?
It depends on the state. Usually it is the state's compulsory registration law for all marriages, such as the Tamil Nadu Registration of Marriages Act, 2009. In West Bengal, Bihar, Jharkhand and Odisha, older Muhammadan marriage registration acts also exist.
Is the Nikahnama Enough as a Marriage Certificate?
It is proof of the nikah and is accepted for many purposes. For a passport, a spouse visa or most government work, get the state marriage certificate as well, using the nikahnama as the main document.
Who Registers a Muslim Marriage, the Qazi or the Government?
The qazi performs the nikah and issues the nikahnama. The certificate comes from the state's registrar, such as the municipality or sub-registrar. In some states licensed Muslim marriage registrars also register nikahs.
Can a Muslim Marriage Be Registered Under the Special Marriage Act?
Yes. Section 15 allows a marriage already performed to be registered under the Act if the conditions are met. The Act's rules on divorce and succession then apply, so take legal advice first.
