A second marriage after divorce is legally allowed in India once the divorce decree is final, which for Hindus is set by section 15 of the Hindu Marriage Act, 1955. In practice, families start looking again after the person has had some time to settle, the paperwork is complete, and the children (if any) have been thought about. Be open about the divorce in the biodata from day one.
Second marriages are more common than relatives at a function would have you believe. Most matrimony sites now have a "Divorced" filter, and many families search for it on purpose.
Is a Second Marriage After Divorce Accepted in India?
Yes, by law and more and more by families. The law has no waiting period beyond the decree becoming final. Social acceptance depends on the community and the town. In a metro it often comes up as a fact. In a small town, an aunt may still lower her voice when she says "divorcee".
Divorced men usually face fewer questions than divorced women. That is unfair, but it is real, and it helps to know it before the search starts. A divorced woman with a steady job and her family behind her finds matches. So does a divorced man who is honest about why the first marriage ended.
When Are You Legally Free to Remarry?
Under section 15 of the Hindu Marriage Act, 1955, a divorced person can marry again once the decree is final. That is when no appeal lies, the appeal period has expired, or an appeal has been dismissed.
| Type of divorce | When you can remarry |
|---|---|
| Mutual consent decree | Usually soon after the decree, as no appeal normally lies; confirm with your lawyer |
| Contested decree | After the 90-day appeal period under section 28, if no appeal is filed |
| Decree under appeal | Only after the appeal is decided |
Marrying while a divorce case is still pending is bigamy. It is an offence under section 17 of the Hindu Marriage Act and section 82 of the Bharatiya Nyaya Sanhita, 2023, and the second marriage would be void. Keep a certified copy of the decree. The other family may ask to see it, and the marriage registrar will.
If you are still in the middle of the case, our guide to the divorce process in India explains the stages.
Are You Ready? A Short Checklist
The law decides when you can marry. Only you can decide when you should. Go through this honestly:
- You can talk about the first marriage without anger taking over.
- You are not looking for someone to prove a point to your ex-spouse or their family.
- The money and custody terms of the divorce are settled and being followed.
- Your children, if old enough, have been told that you are thinking of remarrying.
- You know what went wrong last time, including your own part in it.
- You are not marrying only because your parents are worried about "what people will say".
If most of these feel true, start. If not, give it a few more months. A counsellor can help, and Tele-MANAS, the government's free mental health helpline, answers on 14416.
Talking to Your Family
Parents of a divorced son or daughter often carry their own guilt. Some want to rush into the next proposal. Some want to stop all talk of marriage.
Have one sit-down conversation before the biodata goes out. Agree on three things: who will handle the first calls, what the family will say about the divorce, and which conditions are firm (same city, accepting a child, and so on).
Agree on the words too. "The marriage did not work out and the divorce was by mutual consent in 2025" is enough for a first call. Details come later, and only to a family that is serious.
Where Do Divorced People Find Matches?
The same places as everyone else, with a few that work better.
| Where | What to expect |
|---|---|
| Relatives and family friends | Still the most trusted route; tell them clearly that you are open to a second marriage |
| Community marriage bureaus | Many keep a separate list for remarriage |
| Matrimony sites | Use the "Divorced" or "Awaiting divorce" filters honestly |
| Second-marriage platforms | Some sites focus only on divorced and widowed people |
| WhatsApp groups | Useful in some communities; never send money to anyone you meet there |
Online search has its own risk. Report anyone who asks for money or gifts to the national cyber crime helpline, 1930, or on the National Cyber Crime Reporting Portal.
Questions to Ask a Divorced Match
A divorced match will expect these questions. Ask them gently, and later in the talks, not on the first call.
- How long ago was the divorce, and is the decree final?
- Was it mutual or contested?
- Are there children, and who do they live with?
- Is there alimony or child support being paid or received?
- Are any cases still pending between the two families?
- What would they do differently in a second marriage?
The last question tells you the most. A person who blames only the ex-spouse for everything has not finished thinking about it.
For the wider list of questions every couple should cover, see our guide on questions to ask before an arranged marriage.
Children and Step-Families
When either side has a child, the marriage includes the child. Talk about it early and clearly.
Ask where the child will live, which school, and how the other parent will stay in touch. Ask what the new partner expects to be called. Some children say "Papa" or "Amma" within months, and some never do. Neither is a failure.
If the child is older than eight or nine, let them meet the new partner a few times before the engagement. A child who feels ambushed by a wedding date often makes the first year hard for everyone.
How to Mention Divorce in the Biodata
Write it plainly in the Marital Status line. Hiding it only means the other family hears it from someone else, and then trust is gone.
| Field | Example entry |
|---|---|
| Marital Status | Divorced (mutual consent, 2025) |
| Children | One daughter, 6 years, living with me |
| About Me | One line about where you are now, not the story of the divorce |
| Partner Preference | Open to a divorced or widowed partner; open to a partner with children |
On our form, Marital Status is a pick list, so choose Divorced there. The year and the children go in with Add Your Own Field, and the expectations as the last line of About Me.
Leave out the reasons for the divorce and anything about the former spouse. Those belong in a conversation, not on paper. The age gap question also comes up more in second marriages, and our post on age difference in marriage covers how families think about it.
You can make the biodata here and download it as a PDF or JPG to send on WhatsApp. In our form, Marital Status is under Add More Details in Personal Details, with Never Married, Divorced, Widowed and Awaiting Divorce. Our marriage biodata format page shows where that line sits among the other sections.
There is no Children or Partner Preference box. Use Add Your Own Field in Personal Details and name it "Children", and put your partner preference as the last line of About Me.
Common questions
How Soon After Divorce Can I Remarry in India?
As soon as the decree is final. For a contested decree that usually means after the 90-day appeal period. For a mutual consent decree it is usually sooner, but ask your lawyer to confirm the date.
Is It Good to Marry a Divorced Man or Woman?
A divorce tells you the first marriage ended, nothing more. Judge the person by how they talk about it, what they learnt, and how they treat you and your family.
Which Matrimony Sites Are Good for Divorced People?
Most large matrimony sites have a marital status filter, and some smaller sites focus only on second marriages. Whichever you use, be honest in the profile and never send money to someone you have not met.
Should a Divorced Woman Mention Her Child in the Biodata?
Yes. Write the child's age and who the child lives with. A family that is uncomfortable with a child should find out from the biodata, not after three meetings.
Do I Need to Show My Divorce Decree to the Other Family?
You do not have to show it on the first call. Once the talks are serious, sharing a copy is a normal step, and the registrar will need it when you register the new marriage.
